The World Wide Web Consortium (W3C) established the main international standards and accessibility for the World Wide Web. The WCAG is created by the W3C to provide a standard for web content accessibility that can be shared around the world. The WCAG is meant to accompany organizations as a sort of blueprint on how to make their websites ADA compliant.
And once those new customers tell their friends and relatives how they found your website, more people will know you made sure to make it ADA compliant. The fact that you put this effort into ensuring everyone was included will set you apart from your competitors. Therefore, making your site ADA compliant is a great way to get some positive press for your business.
On September 25, 2008, President George W. Bush signed the ADA Amendments Act of 2008 (ADAAA) into law. The amendment broadened the definition of "disability", thereby extending the ADA's protections to a greater number of people.[43] The ADAAA also added to the ADA examples of "major life activities" including, but not limited to, "caring for oneself, performing manual tasks, seeing, hearing, eating, sleeping, walking, standing, lifting, bending, speaking, breathing, learning, reading, concentrating, thinking, communicating, and working" as well as the operation of several specified major bodily functions.[43] The act overturned a 1999 US Supreme Court case that held that an employee was not disabled if the impairment could be corrected by mitigating measures; it specifically provides that such impairment must be determined without considering such ameliorative measures. It also overturned the court restriction that an impairment which substantially limits one major life activity must also limit others to be considered a disability.[43] In 2008, the United States House Committee on Education and Labor stated that the amendment "makes it absolutely clear that the ADA is intended to provide broad coverage to protect anyone who faces discrimination on the basis of disability."[44] Thus the ADAAA led to broader coverage of impaired employees.
The Fair Housing Act is actually what governs the sort of modifications you are describing, not the ADA – and that has nothing to do with building codes of this sort. It requires that accommodations be made in a multifamily housing unit if they are “readily achievable”, which includes a few other requirements like being affordable – which can also get complicated, depending on what needs done, the landlord’s overall financial picture, and a whole lot more.
I have a client that lives in an apartment complex with no ramp access and she was just approved and delivered a new Power Chair. The stairs are 28″ tall. We provided a ramp but it interferes with the gate that opens. The landlord is trying to find a solution but doesn’t want to put out any money if h doesn’t have too. I suggested to the land lord to build a ramp including a landing that we can install the approved portable ramp onto that was interfering with the gate and place it so it runs parallel with the gate to accommodate the client. We are not company that can install modular ramps (at this time) but the landlord doesn’t seem to want to help much and I was trying to get an answer for him of exactly what his responsibility is since this is the first time that we have encountered an issue with the portable ramps.
As of 2015 the ADA had improved access to public services, the built environment (e.g., crosswalks with curb cuts and accessible pedestrian signals), understanding of the abilities of people with disabilities, established a right to equal access to public services and has demonstrated the contributions which people with disabilities can make to the economy. Disparities have remained in employment, earned income, Internet access, transportation, housing, and educational attainment and the disabled remain at a disadvantage with respect to health and health care.[45]
With this legislation, California joins state and municipal entities in other parts of the country that have similar web accessibility requirements for governmental entities and contractors.  This legislation fills a small part of a void the federal Department of Justice has decided for the time being not to fill, when it put its pending regulations that would set an accessibility standard for state and local (as well as private entity) websites on the inactive list.

I live in a senior housing apt building in San Diego Ca. We have three sides of our building streets used by the MTS transportation system for bus depo and trolley. The buses are parked directly in front of our entrance where the disability ramp is and the small one car white loading zone is located at the end of the block. The busses are blocking emergency vehicle access and the residents are being picked up daily by disability medical transit buses which are supposed to go to the white zone down the block but it is always being used by someone. Instead the medical vans are parking in the red zones directly in front of the disability ramp for loading/ unloading. The bus drivers get angry and beep their horns block traffic on the street and yell at the elderly residents. I have been writing and providing photos and calling so many city employees and agencies, attorneys, ADA compliance officers about this for 8 months yet they all say we can use the little white zone up the street because they need the area for the three busses parked there each day. Who can I contact to do a formal assessment of this as everyone else has not even really addressed the issue. One guy to,d me we had a building design defect after talking to him for 5 minutes on the phone and he did not even see the photos yet! Please anyone help!!!


WCAG 2.0 AA is the standard on which most website owners are operating and is considered acceptable. As a business owner, it’s important to know which set of standards you should be meeting, but most of these standards are very technical. Therefore, we recommend working with a web firm that specializes in ADA website compliance and is familiar with WCAG 2.0.
The ADA states that a "covered entity" shall not discriminate against "a qualified individual with a disability".[12] This applies to job application procedures, hiring, advancement and discharge of employees, job training, and other terms, conditions, and privileges of employment. "Covered entities" include employers with 15 or more employees, as well as employment agencies, labor organizations, and joint labor-management committees.[13] There are strict limitations on when a covered entity can ask job applicants or employees disability-related questions or require them to undergo medical examination, and all medical information must be kept confidential.[14][15]
We often see projects of gas station replacing old fuel dispensers with access compliance fuel dispensers (reach range, operable parts, point-of-sale). According to Section 11B-202.4, Exception 10, these projects would be required to comply with accessibility for primary accessible path to inside the convenient store at the gas station, public restrooms, drinking fountains, public telephones, and signs (with 20-percent limit of adjusted construction cost). Is my understanding correct regarding the replacement of old/addition of new fuel dispensers?

I own a condo in Anaheim Ca. My son has recently become handicapped and in a wheelchair. We have handicap parking and visitor parking. But we have No Ramps or other ways for handcap people to get to the condo’s. I have asked the HOA at a meeting if we could install a temporary ramp in a common area so our son can be able to get in and out of our condo in the case of an emergency. I had a company build us a 2 ramps. One for our porch, and one for the common area. It was built to as close to code as possible with the length of walk way we had. They allowed us to keep the porch ramp and denied the common area ramp. They said it was not safe. And told us we can’t install the ramp because it isn’t safe. I paid to have these ramps made and they haven’t even seen the ramp or inspected the ramp. Just said no. What can I do? Terry
The question of fixing the elevator is an entirely different matter (and one with which I am personally struggling in my own home), depends on local building codes and the specifics of the building, and you will need to start with the local building department to see if there is any way to get the situation rectified if the landlord is unresponsive.
This was a case filed before The United States District Court for the Eastern District of Michigan Southern Division on behalf of the Michigan Paralyzed Veterans of America against University of Michigan – Michigan Stadium claiming that Michigan Stadium violated the Americans with Disabilities Act in its $226-million renovation by failing to add enough seats for disabled fans or accommodate the needs for disabled restrooms, concessions and parking. Additionally, the distribution of the accessible seating was at issue, with nearly all the seats being provided in the end-zone areas. The U.S. Department of Justice assisted in the suit filed by attorney Richard Bernstein of The Law Offices of Sam Bernstein in Farmington Hills, Michigan, which was settled in March 2008.[66] The settlement required the stadium to add 329 wheelchair seats throughout the stadium by 2010, and an additional 135 accessible seats in clubhouses to go along with the existing 88 wheelchair seats. This case was significant because it set a precedent for the uniform distribution of accessible seating and gave the DOJ the opportunity to clarify previously unclear rules.[67] The agreement now is a blueprint for all stadiums and other public facilities regarding accessibility.[68]
This particular lawsuit amounted to nothing more than a shakedown for cash, as the current laws would make it difficult to win the suit in court (more about this later) but it prompted me to dive deeper into the issue of ADA compliance. Through my research, I discovered there are some new laws on the horizon that could make ADA compliance mandatory, which means web designers and digital marketers need to know how to prepare.
I work in a building with five businesses and two residences, there is only one handicapped parking space that one of the residences parks permanently in, her car rarely moves. She has two cars one is parked in a regular space & the other is in the handicap. This creates no handicap parking spaces for customers. Is this compliant in San Diego County? If not what can be done? A conversation has taken place with the owner of the building, he is not willing to give the tenant her own residential handicap spot and leave another handicapped spot for customers. He’s not willing to do anything.

In one case where the defendant, Bang & Olfusen, won its motion to dismiss, the court noted that the plaintiff had failed to plead a nexus between the physical place of public accommodation and the website in question. In the other case, the court dismissed the claims made against Domino’s because requiring the defendant to comply with a set of web accessibility guidelines that are not yet law would violate due process principles.  The Domino’s decision is on appeal and will be reviewed by the Ninth Circuit in 2018.  Our post about these cases is here.


It is important to remember that a disability placard or special license plate with an ISA can be issued to a driver or passenger for a disability that does not necessitate the use of a wheelchair or mobility device; therefore it is incorrect to assume that an accessible EVCS will be underutilized, because disability placard holders may have an electric vehicle or may purchase one in the near future.
For the next few months I corresponded with this housing authority, until I caught the attention of the regional manager, likely because I registered his letter. He called and asked to visit, upon his arrival, accompanied by our maintenance person, who having seen the pictures and the stove above the countertop, still maintained all the countertops are the same height. The R/M inspected this anomaly and the maintenance man still stated the countertops are all the same, I said no they are not and the R/M turned and asked which were not, I told him which apt my friend lived in and he headed that way. When he returned he stated I was correct and he would see about fixing this mistake and the maintenance person apologized. I never heard back from him, one day I found him in the hallway and asked what is the plan and he stated that I needed to put in a request for a reasonable accommodation, which makes no sense, in my reasoning all of ADA constitutes a reasonable accommodation, however, I did not nor would I request it. Furthermore, had I known they were going to do this I would not be on this blog?
Mention ADA compliance to many web developers and you may encounter a blank stare. First, find an agency working with the web platform or framework you use and ask about how their development workflow addresses accessibility. Most platforms have a partner directory. From there, you can start vetting agencies for their actual experience with web accessibility.
