The California Labor Code requires separate facilities whenever there are more than four employees. Where separate facilities are provided for nondisabled persons of each sex, separate facilities shall be provided for persons with disabilities of each sex also. Where unisex facilities are provided for persons without disabilities, at least one unisex facility shall be provided for persons with disabilities within close proximity to the non-accessible facility.
The home we own was previously used as a hospice care home. It appears to be completely ADA compliant. We are going to be renovating our back patio and will be demoing the current one completely. Our deck builder has said when they build the new deck, it will start two inches lower than the current one in purser to meet code standards. We do not have anyone who lives here that needs it to be ADA, just aging parents that visit. That two inch step down will make it difficult for them to navigate, especially one parent who can’t do any steps at at all. Even though we are not a business, can we still have our home to be ADA compliant? Are there different codes for residents vs businesses? Thank you
That would be great for a referral. I am trying to fid one on my own, and am striking out on this. I’m somewhat confused though by the recently passed CA law (smaller businesses with < 25 employees can take advantage of the ADA CASP program to avoid being liable for any type of payment. That's how I'd interpreted this new regulation). The thing is he was in fact told to do this 4 + years ago (I know for a fact). My concern is maybe county zoning would have no record of this (it was in a citation)? Or, my LL would suddenly have amnesia. Thanks too.
ADA website compliance is a hot topic among any business that has a website (and in today’s world, that really is 99% of them). You’ve likely seen news stories about companies that are getting sued or settling out of court for having a website that doesn’t comply with the American Disabilities Act and you’re also probably wondering if this affects you or your business.

Many properties do NOT have enough electricity available to support significant charging installations, so for now, utilities and others are doing “make ready” spaces (upgrading the supporting infrastructure in a parking space for future use without adding the actual charger). How would make ready spaces comply with the ADA standards? Additionally, consider a site with 10 make ready spaces. Would the standards apply differently if that site has no chargers presently installed versus having one active charger installed?

Title III of the Americans with Disabilities Act (ADA) authorizes the United States Department of Justice to certify that state laws, local building codes, or similar ordinances meet or exceed the ADA Standards for Accessible Design for new construction and alterations. Good afternoon. My son with disabilities attends an elementary school. Most children in his class have ambulatory issues. All have mental development issues. There is not one entrance to the school, school buildings, or classroom that has an automatic door opener. When questioned about this I was told because there is always some one there to help get thought the doors it’s okay. This isn’t true. But even if someone were is that answer/situation acceptable? Is a public school allowed to not be in ADA compliance? Thank you for your response.
The "building official" is the officer or other designated authority charged with the administration and enforcement of this code, or the building official's duly authorized representative in accordance with state law. Local cities and counties have building officials who regulate construction in their jurisdiction. State funded construction on state property is often regulated by a state agency, such as the Division of the State Architect. Sometimes public construction has more than one building official — each has separate jurisdictional oversight responsibilities.
Settlements like these were entered into across the country, and 2015 included: edX, Inc. and Carnival Cruise Lines (Carnival Corp.). Needless to say, by the mid to early 2010s, the DOJ were well aware of website accessibility issues and knew exactly where it stood on these issues. In the fall of 2014, the DOJ issued a Statement of Regulatory Priorities stating, “the Department received approximately 440 public comments and is in the process of reviewing these comments… the Department plans to follow with the publication of the title III NPRM in the third quarter of fiscal year 2015.” That did not happen. Rather, in the fall of 2015, the DOJ decided to “extend the time period for development of the proposed Title III Web site accessibility rule and include it among its long-term rulemaking priorities. The Department expects to publish Title III Web site accessibility NPRM during fiscal year 2018.” In 2016, the DOJ requested additional public comment. And this year, the Trump Administration placed the DOJ’s rulemakings under Titles II and III of the ADA for websites, medical equipment, and furniture of public accommodations and state and local governments on the 2017 Inactive Actions list.
Title III also has applications to existing facilities. One of the definitions of "discrimination" under Title III of the ADA is a "failure to remove" architectural barriers in existing facilities. See 42 U.S.C. § 12182(b)(2)(A)(iv). This means that even facilities that have not been modified or altered in any way after the ADA was passed still have obligations. The standard is whether "removing barriers" (typically defined as bringing a condition into compliance with the ADAAG) is "readily achievable", defined as "...easily accomplished without much difficulty or expense".
I work in a State Government office on the second floor. It has one elevator on the West side of the building. There are stairs on the West side, mid-way, and on the East side of the building which is secured. There is handicap parking on each side of the building, but with no additonal elevators and very limited handicap parking people with disabilities are struggling. Can you tell me what if anything can be done about this matter? There is a neighboring building that has parking right in from of ours on the West side that refuses to allow anyone including those with handicap placards to park there or else be towed. Can you assist with further information?

We are starting a project in an residential area that does not have existing sidewalks, we will have a backhoe working on the road digging holes what types of signage and how are we to deal with the ada requirements in an area that doesn’t have pre-existing sidewalks or a clearly delineated path? ADA compliance isn’t a set-it-and-forget-it thing. Compliance standards must be followed and will evolve just as your website does. There are guidelines all website contributors must know to stay within ADA guidelines. It is generally not burdensome but it does require some web managers to change their workflows. For example, loading images up to your ecommerce site will always need some of that alternative text (alt tags) mentioned above.
In 2001, for men of all working ages and women under 40, Current Population Survey data showed a sharp drop in the employment of disabled workers, leading at least two economists to attribute the cause to the Act.[52] By contrast, a study in 2003 found that while the Act may have led to short term reactions by employers, in the long term, there were either positive or neutral consequences for wages and employment.[53] In 2005 the rate of employment among disabled people increased to 45% of the population of disabled people.[54]
My husband and I are Airbnb hosts and rent out one bedroom in our primary residence to potential guests, usually for one week or less. Recently, we received an inquiry and the potential guest indicated that they had a service animal. Although we do not allow pets (we have our own small dog who is people-friendly but not always dog-friendly), I felt I should tread carefully concerning this request. Are there any laws concerning welcoming service animals into my home if I am running a business from said home? Airbnb always indicates that we set the rules in our own homes but suggested if I want more information, to contact my local government. I live in an unincorporated area of Santa Barbara County. The other day the mall security in the mall I was shopping turned off the escalators. I am perminately handicapped and it is difficult for me to walk. So my wife asked the security officer to turn on the escalator and the reply was you have to walk to the end of the mall and use the elevator, once the escalator was turned off they could not turn it back on. Just looking for clarification if this considered harassment and or is against ADA guidelines

State agencies have been required, since January 1, 2017 by virtue of 2016 legislation, to comply with Section 508 in developing, procuring, maintaining, or using electronic or information technology “to improve accessibility of existing technology, and therefore increase the successful employment of individuals with disabilities, particularly blind and visually impaired and deaf and hard-of-hearing persons.” That statute, Government Code 7405, also requires entities that contract with state or local entities for the provision of electronic or information technology or related services to respond to and resolve any complaints regarding accessibility that are brought to the entity’s attention.


On October 14, 2017 California Governor Jerry Brown signed into law AB 434, which will create a new Government Code section 11546.7 and require, beginning July 1, 2019, state agencies and state entities to post on their website home pages a certification that the website complies with the Web Content Accessibility Guidelines 2.0 Level AA, or a subsequent version, and Section 508 of the Rehabilitation Act.

The California Building Standards Code says that you must get a final determination from the local building official that your project has an unreasonable hardship. This is rarely granted for new construction. Existing buildings undergoing alteration are sometimes allowed to depart from the literal requirements of the building code only when equivalent facilitation is provided.
