What do you want your website to look like? Consider websites that are similar to the one you’d like to build, ideally in the same industry or serving similar types of customers. Build a set of examples of types of pages, design aspects, and website features that you can hand off to the web designer — the person you hire should have experience creating websites with the features you want. If they don’t have the right skill set, they’re not the right pro for you.

When you're small, focus on building your brand first then invest in a 'expert' website after you have proven you have a viable profitable business. I even had a look at some of the 'top' competitors in my field and boy Wix will just do guys. Your business is NOT your website. Business creates websites. Websites DON'T create business!

Therefore, the DOJ’s current position is that Title III applies to all publicly-accessible websites used by companies that otherwise qualify as places of public accommodation, and companies can make their website accessible by any means, which may include but is not limited to, complying with WCAG 2.0, Level AA requirements (discussed in more detail below).  Until Congress acts to clarify the ADA, courts and regulators will likely continue to cite the WCAG as the “gold standard” for ADA compliance.

Ultimately, the DoJ’s letter has placed the burden back on Congress to legislate regarding ADA website accessibility.  However, it is unlikely that it will take any action any time soon.  While the DOJ’s letter is helpful for businesses, it will not stop these ADA website accessibility lawsuits.  Therefore, businesses should take proactive steps toward making their websites accessible.  Employers must also remember that their failure to make online job applications accessible to blind or disabled job applicants may subject them to liability under Title I of the ADA, which prohibits discrimination in hiring decisions, and which carries with it additional remedies such as compensatory damages (to pay a plaintiff for out-of-pocket expenses caused by the discrimination and compensate him/her for any emotional harm suffered), and punitive damages.

You may have noticed a common theme among these cases. Most of these cases’ plaintiffs were visually impaired individuals that couldn’t use their screen reading software with a website. It’s vital to note that disabilities extend well beyond blind individuals and all companies should adhere to all-encompassing best practices as it relates to ADA website compliance.
Distinguishable: To assist color-blind users and those with other visual impairments, color is never used as the sole means of conveying information or prompting the user. Audio lasting more than 3 seconds can be paused, or the volume can be controlled independently of the system volume. Regular text has a contrast ratio of at least 4.5:1, and large text has a contrast ratio of at least 3:1. In addition, text can be resized up to 200 percent without causing issues with the website.
Winn Dixie appealed to the Eleventh Circuit Court of appeals, which held oral argument on October 4, 2018.  Winn Dixie argued that:  (1) websites are not places of public accommodation under Title III of the ADA; (2) the WCAG are not law and the trial court’s adoption of those guidelines violated due process; and (3) Winn Dixie is in compliance with the ADA because Gil had not been deprived of the full benefit of and equal access to the services and goods in Winn Dixie’s stores.  The Eleventh Circuit will likely issue its opinion in the first months of 2019, which can potentially, and significantly impact the landscape of website accessibility cases within the Eleventh Circuit (Alabama, Florida, and Georgia) by clarifying or definitively adopting a standard (e.g., the WCAG) under which courts will analyze whether a company’s website is ADA accessible.
On September 25, 2018, Assistant Attorney General Stephen E. Boyd, sent a letter in response to a June 20, 2018 letter from a bi-partisan group of 103 members of the U.S. House of Representatives, requesting clarity on “unresolved questions about the applicability of the ADA to websites” which have “created a liability hazard that directly affects businesses in our states….”  The DoJ responded:

Of the 814 federal cases, New York and Florida led the way with more than 335 and 325 cases, respectively. Surprisingly, California only had nine new website accessibility lawsuits in 2017, most likely because plaintiffs filed in state court.  Federal courts in Arizona (6), Georgia (9), Illinois (10), Massachusetts (15), New Hampshire (2), Michigan (1), New Jersey (4), Ohio (8), Pennsylvania (58), Puerto Rico (1), Texas (7), and Virginia (24) also had their share of website accessibility lawsuits.

In one case where the defendant, Bang & Olfusen, won its motion to dismiss, the court noted that the plaintiff had failed to plead a nexus between the physical place of public accommodation and the website in question. In the other case, the court dismissed the claims made against Domino’s because requiring the defendant to comply with a set of web accessibility guidelines that are not yet law would violate due process principles.  The Domino’s decision is on appeal and will be reviewed by the Ninth Circuit in 2018.  Our post about these cases is here.

In short, the DOJ is dedicated to making sure that individuals with disabilities have the same equal access to the benefits that are available online. Creating equal access is only possible if organizations a) understand the requirements of web accessibility, b) know that web accessibility is an obligation under the ADA, and c) make web accessibility a priority. The value that awaits when organizations adhere to digital accessibility laws can be measured in more than dollars and cents.
